Auction & Bidding Terms

Last updated: July 1, 2026

This is a general-purpose bidding terms template, not legal advice. Have it reviewed by an attorney before publishing, and confirm it aligns with your online auction platform's own terms of service.

Who these terms apply to

These Auction & Bidding Terms govern anyone who registers to bid on, wins, or purchases items through a Beacon Assets Group auction, whether hosted on our website or our third-party bidding platform.

Registration

To bid, you must register an account, provide accurate contact and payment information, and be at least 18 years old. You are responsible for all bids placed under your account.

Item condition — sold as-is, where-is

All items are sold "as-is, where-is," with no warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose. We describe items to the best of our ability, but photographs and descriptions are not guarantees of condition. You are responsible for reviewing listing photos and descriptions before bidding.

Buyer's premium and payment

  • An 18% buyer's premium is added to the winning bid on every lot.
  • By placing a bid, you authorize us to automatically charge the payment card on file for the full amount (winning bid plus buyer's premium) once the auction closes.
  • All sales are final. We do not offer refunds once a bid has won, except where required by law.

Pickup requirements

  • Winning bidders will be notified of their assigned pickup date and a staggered arrival window.
  • You must bring valid photo ID and be prepared to identify your won lots at pickup.
  • Items not collected during the scheduled pickup window may be forfeited without refund, at our discretion, unless other arrangements were made in advance.
  • You are required to inspect your items at pickup and sign a Load-Out Release confirming item count and condition before leaving the premises. Once you sign and leave with your items, no further claims regarding condition or count will be accepted.

Conduct and safety at pickup

Pickup occurs at a private residence or property. You agree to follow the directions of Beacon Assets Group staff on site, stay within designated areas, and remove only the items assigned to your account. Beacon Assets Group is not responsible for injury to bidders or their agents during pickup, except to the extent caused by our negligence.

Cancelled or withdrawn lots

We may withdraw, cancel, or relist a lot at our discretion — for example, if an item is damaged, misdescribed, or otherwise cannot be delivered. In that case, your payment for that lot will be refunded; no other compensation is owed.

Prohibited conduct

Shill bidding, bid manipulation, chargeback abuse, and any attempt to interfere with the auction process are prohibited and may result in account termination and forfeiture of any pending bids.

Limitation of liability

To the fullest extent permitted by law, Beacon Assets Group's total liability arising from any auction transaction is limited to the amount you paid for the item(s) in question.

Governing law

These terms are governed by the laws of the State of Colorado.
